Capacity is the number of people who may reasonably be expected on site at the same time — staff included.
How the tiers work
Premises are in scope where they are wholly or mainly used for a Schedule 1 purpose and 200 or more individuals may reasonably be expected to be present at the same time. That figure includes staff.
200 to 799 is standard tier. 800 or more is enhanced tier — except for places of worship, childcare, and primary, secondary and further education, which Schedule 1 holds at standard tier whatever their capacity. Higher education is not in that group, so universities can fall into the enhanced tier.
Qualifying events are separate: there is no standard tier for events. An event is in scope only at 800 or more with entry controls, and only where the premises are not already enhanced duty premises.
